PURCHASE CONDITIONS - GENERAL INFORMATION

 

These general contracting conditions apply to all commercial transactions carried out in our virtual store GADGETFIX.ES, hereinafter referred to as The Seller. For more information about The Seller and our Privacy Policy, please consult the Legal Notice located at the bottom of each page of this store.

 

We kindly ask you to carefully read these Purchase Conditions and our Privacy Policy before placing an order. If you do not agree with all the Purchase Conditions and the Privacy Policy, you should not place any order.

 

IDENTIFICATION

 

The Seller is a business unit belonging to OFFIXUM HABIX SLU, with VAT ID B93744894, domiciled at Av Andalucía, 25, Benahavís (Málaga). Any communication can be directed to the registered office or the phone number 602563503 or the email address info@gadgetfix.es.

 

ACTIVITY

 

The Seller is dedicated to distance selling, preferably online, of retail technological products.

 

CONTENTS AND INFORMATION PROVIDED ON THE WEBSITE

 

The Seller reserves the right to modify the commercial offer presented on the website (modifications on products, prices, promotions, and other commercial and service conditions) at any time. The Seller makes every effort within its means to offer the information contained on the website truthfully and without typographical errors. In the event that at any time such an error occurred, completely unintentional at all times from The Seller's side, it would immediately be corrected. If there is a typographical error in any of the prices shown and a customer had made a purchase decision based on said error, The Seller will communicate this error to the customer, and the customer will have the right to cancel their purchase at no cost on their part.

 

The contents of The Seller's website could, on occasions, show provisional information about some products. In the case that the information provided does not correspond to the product's features, the customer will have the right to cancel their purchase at no cost on their part. The photographs of main products shown on the web will always be those that are marketed, there may be merely informative secondary photographs that do not correspond to the original product, only as an example.

 

APPLICABLE TAXES

 

The prices of the products displayed on The Seller's webpage include the Value Added Tax (VAT) that, if applicable, must be applied.

Purchases to be delivered within the territory of any of the European Union member states will be subject to VAT. The set prices are net and final, and due to the taxation of the holder, VAT is not discounted on shipments outside the peninsula.

 

PAYMENT METHOD

 

Payment by credit card.

Customers can pay securely with their Visa, Mastercard, or Maestro card through a secure payment gateway.

 

SHIPPING AND TRANSPORT CONDITIONS

 

The order will be shipped to the address specified by the customer.

The cost for national shipping (Peninsula and Balearic Islands) will be:

€5 + VAT for purchases up to €50
€3 + VAT for purchases over €50 to €200
FREE for purchases over €200
For shipments to the Canary Islands, Ceuta, and Melilla, please consult.

 

The goods will be shipped to the address indicated by the customer.

The usual delivery time will be 24 hours for the entire peninsular national territory, except for remote populations where transportation cannot deliver in less than 48h.

The indicated deadlines are estimative and not binding since they are carried out by a third party, which is the transport. The Customer will not have the right to request the cancellation of an order or any other compensation in the event of a delay in the delivery of the goods for reasons beyond The Seller's control.

The transport agencies we work with are mainly SEUR and Tourline Express. The Seller reserves the right to select in each case the most suitable company to offer the best service to the customer.

The goods, unless otherwise agreed, will be sent at the customer's expense and risk by means of the carrier determined by them, The Seller not being responsible for any damage or loss that may occur by the transport agencies.

Upon receipt of the goods by the Customer, it will be necessary, for possible claims, to note on the carrier's delivery slip any incident that may exist in the state of the goods or their packaging. Such incident must be communicated by email within less than 24 hours. Otherwise, it will be understood that the product has been accepted in conformity.

 

WITHDRAWAL

 

The Customer may make commercial return requests during the 15 natural days following the purchase. Returned products must be sealed as they were found in their original packaging and of course, they cannot have been used or have been assembled or installed. If the product meets the commercial return conditions, a refund equivalent to the current price of the product will be made, provided it does not exceed the original invoice price (in which case it will be matched to it). If the product does not meet these conditions, it will be returned to the Customer prior notice by mail with the corresponding information.

Return requests must always be processed via email to info@gadgetfix.es.

The Customer will have a period of 7 natural days once the request has been made for the products to arrive at our facilities accompanied by the corresponding stickers and delivery slips. Otherwise, the request will be canceled.

Requests for products on demand (48h delivery), electronic licenses, custom-configured equipment requested by the customer, or those whose dimensions have a high incidence rate in transport (such as gaming chairs and tables, rack cabinets, high-inch televisions, etc.) will not be admitted.

 

WARRANTY AND CLAIMS

 

The warranty time for each product is indicated on the purchase invoice. For those products whose warranty is directly covered by the manufacturer, the responsibility derived from it will be exclusively theirs.

The warranty covers the physical imperfections of the material support of the product delivered to the Customer, The Seller being responsible for the labor and necessary material in case of assembled equipment and monitors, or the substitution of the material for another of similar characteristics although not necessarily of the same brand, in case of loose material, but in no case the shipping costs of the goods by the customer to The Seller. This warranty will always apply provided the Customer has used the product under normal operating conditions such as described in catalogs, manuals, and usage instructions made available to the Customer. Defects caused by computer viruses will not be covered by this warranty.

An indispensable condition for repairs-returns is to process the return via email to info@gadgetfix.es, as well as to include the packaging, manuals, digital supports, documents, cables, keys, and other original accessories in perfect conservation conditions, and a copy of the purchase invoice.

The customer must check the goods upon receipt. If there is any incident, they will notify the same via email to info@gadgetfix.es.

The customer has a period of 2 natural days to notify The Seller of any possible incidents (including photographs in which the affected item can be seen in full and the damage or discrepancy can be appreciated):

Non-visible damage detected after receipt

Visible damage detected upon receipt

Discrepancy of units - missing or surplus units in the order

Incomplete products - products missing accessories or parts

The failure to present any of the necessary images for the management within the stipulated period may lead to the case being dismissed.

The customer may request a pickup once a week at no cost and as many as needed by their own means.

If the product does not comply with the warranty conditions, it will be returned to the Customer prior notice by mail with the corresponding information. If it is found that there is no defect in the material, it will be returned at the customer's expense following the customer's instructions.

The Seller is not obligated to compensate the user or third parties for the consequences of the use of the product, whether direct or indirect damages, accidents suffered by people, damage to property other than the product, loss of profit or profit ceasing, damages that come from a deterioration, or losses of data recorded by the user.

 

CUSTOMER OBLIGATIONS

 

The customer of The Seller commits at all times to provide truthful information about the data requested in the user registration forms or the placing of an order, and to keep them updated at all times.

The customer commits to accept all the provisions and conditions contained in these Purchase Conditions, understanding that they collect the best service will possible for the type of activity that The Seller develops.

Also, they commit to keep their personal access keys to our website confidential and with the utmost diligence.

The customer commits to enable the delivery of the requested order by providing a delivery address where the order can be delivered within the usual delivery schedule of goods (from Monday to Friday from 10:00 to 13:30 and from 16:00 to 18:00). In case of non-compliance by the customer with this obligation, The Seller will have no responsibility for the delay or impossibility of delivering the order requested by the customer.

 

APPLICABLE LEGISLATION AND COMPETENT JURISDICTION

 

The sales made with The Seller are subject to the legislation of Spain.

In case of any conflict or discrepancy, the applicable jurisdiction will be that of the Courts or Tribunals of the Seller.
